Terms & Conditions Of Use

These Terms and Conditions (“Terms”) govern your access to and use of the SwyftSend mobile application and related services (“Services”). By using SwyftSend, you agree to be bound by these Terms. If you do not agree, please discontinue use immediately.

1. Acceptance of Terms

By accessing or using SwyftSend, you confirm that you have read, understood, and agreed to be legally bound by these Terms and all applicable laws and regulations. If you do not accept these Terms, you must not use our Services.

2. Service Overview

SwyftSend provides a digital platform that enables users to transfer funds internationally, primarily for personal remittance purposes. By using SwyftSend, you agree to:

  • Provide accurate and complete remittance instructions.
  • Ensure you are the beneficial owner of the funds being transferred.
  • Use the Services solely for lawful purposes.

We do not accept instructions given on behalf of third parties without proper authorisation and verification.

3. Account Registration and Verification

Access to our Services requires account registration and successful completion of identity verification. We authenticate:

  • Your identity (via government-issued photo ID).
  • Liveness (biometric verification).
  • Proof of address.
  • Ownership of your payment instruments.

You agree to provide accurate, current, and complete information during registration and to promptly update your information as necessary. Failure to complete verification or submission of false information may result in account suspension or termination.

4. Payment Terms

Billing and Payment Methods: We issue billing statements electronically. Acceptable payment methods include credit cards, debit cards, e-checks, and standard checks. Irrevocability: All payments are non-cancellable and non-refundable once processed, except as permitted under the Refund Policy. Service Fees and Exchange Rates: Any fees and applicable exchange rates will be disclosed before you authorise a transaction. Exchange rates may include a markup over the interbank rate.

5. Refund Policy

You may request a refund within 15 days of a transaction date under the following conditions:

  • The original transaction amount and service fee are both eligible for refund.
  • The funds have not yet been released to the recipient.

Refunds will be processed back to the original method of payment. We reserve the right to request additional information and documentation to process a refund request.

6. User Responsibilities

You agree:

  • To use the Services solely for legitimate and lawful transactions.
  • To bear sole responsibility for local taxes, fees, and other governmental charges that may apply.
  • Not to engage in activities such as money laundering, fraud, or financing of terrorism.

You are solely responsible for compliance with any local, national, or international laws that apply to your use of SwyftSend.

7. Compliance with KYC/AML/CTF Obligations

We are committed to compliance with applicable laws and regulations regarding:

  • Know Your Customer (KYC).
  • Anti-Money Laundering (AML).
  • Counter-Terrorism Financing (CTF).

We may monitor transactions and reserve the right to report suspicious activity to the relevant authorities without prior notice to you. You authorise us to use, store, and share your personal data as necessary for regulatory compliance.

8. Transaction Limits and Restrictions

We may impose:

  • Maximum and minimum transaction limits.
  • Frequency limits on transactions.
  • Restrictions on destination countries.

These may be applied at our discretion based on regulatory requirements, risk assessment, or operational needs. We reserve the right to modify or suspend limits without prior notice.

9. Liability and Warranty Disclaimer

The Services are provided “as is” and “as available,” without any warranties of any kind, whether express or implied. To the maximum extent permitted by law:

  • We disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
  • We are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, goodwill, or data, arising out of your use or inability to use the Services.

10. Termination and Suspension

We may suspend or terminate your access to the Services at any time without liability if:

  • You breach these Terms.
  • Payment-related issues occur.
  • You fail to meet verification requirements.
  • Your actions expose us to legal, regulatory, financial, or reputational risk.

Termination will immediately cease your rights to use SwyftSend, and any remaining funds subject to investigation or compliance obligations may be held or forfeited as required by law.

11. Security

We implement appropriate technical and organisational measures to safeguard your data and protect against unauthorised access. However, no online system can guarantee absolute security. You agree to protect your account credentials and promptly report any suspected breaches.

12. Dispute Resolution

All disputes will first be resolved by good faith mediation. If mediation fails, the dispute shall be referred to and finally resolved by binding arbitration under the rules of [Insert Arbitration Institution]. Notwithstanding the above, either party may seek interim injunctive relief from any court of competent jurisdiction to prevent immediate and irreparable harm.

13. Governing Law

These Terms are governed by and construed under the laws of the United Kingdom, including regulations applicable to small payment institutions and electronic funds transfers.

14. Changes to Terms

We reserve the right to amend these Terms at any time. Notice of material changes will be provided via email or within the application. Continued use of SwyftSend after the effective date of changes constitutes acceptance of the revised Terms.
